The Tea Party and RICO

Having fulfilled their purpose of dumping the vulnerable US economy back into the toilet of recession, the Tea Party wing of the GOP has a final job: to flush it using the president as a commode handle. However, in bragging about it as some kind of ideological triumph, they admit ownership of creating a lucrative opportunity for profiteers to engage in short-selling the United States. As Republican sympathizers and media pundits attempt to divert public attention almost apologetically for this blatant racketeering, the Republican Tea Party members have breached their Congressional oath of office knowing that they cannot be impeached nor be recalled. But they are not above the law. It is called RICO. ...

... Put another way, the way to gain power is through extortion.


That may all look and sound merely political, but it is not. The behavior has less to do with proclamations about ideology and principal than it does about money. In this regard there is an argument that has not yet been made. That argument is that allegedly these Tea Party Representatives in Congress have deliberately conspired to devalue the US credit for political and/or personal benefit. Whether it has to do with preparation for an election or not, allegedly they have knowingly or otherwise been party to committing the following actions punishable under the RICO Act: securities fraud, obstruction of justice and extortion.


Originally written to go after the Mafia in 1970, Congress passed the Racketeer Influenced and Corrupt Organizations (RICO) Act [Title 18, United States Code, Sections 1961-1968]. However, RICO is almost never applied to the Mafia today. RICO is applied to individuals and businesses. In addition to criminal claims, Section 1964(c) of the RICO Act allows civil claims to be brought by any person injured by reason of a RICO violation. Tea Party members of Congress are not immune.


Their behavior looks like that of racketeers. As such they could be seen as an ongoing criminal organization subject to RICO that provides for extended criminal penalties and a civil cause of action that focuses specifically on racketeering. RICO allows for the leaders of a syndicate, such as the Tea Party appears to be, to be tried for the alleged crimes which they ordered and assisted. Violations of the RICO laws can be alleged in civil lawsuit cases. It is important to bear in mind that a RICO-related charge focuses on patterns of behavior as opposed to criminal acts. Additionally, a civil RICO action can be filed in state or federal court. Both the federal and civil components allow for the recovery of triple the amount of actual and compensatory damages.


Look at the provision for private parties to sue. For example, stock holders whose stocks lost value can be considered as a "person damaged in his business or property." They can sue one or more "racketeers", Tea Party members. As plaintiffs, the stock holders, including people with 401(k)s must prove the existence of an "enterprise", that they are victims of the racketeers. What needs to be shown is that the defendants conducted or participated in the affairs of the enterprise "through" the pattern of racketeering activity.
The crimes punishable under the RICO Act alleged here are securities fraud, obstruction of justice and extortion.


Tea Party members committed securities fraud in several ways. They made and publicized misstatements on the financial report of United States and the US debt as elected public officials. That resulted in driving down stock prices. As a stock manipulation scheme, that allowed for insider trading. Those fraudulent schemes that have been perpetrated in the securities and commodities markets can ultimately have a devastating impact on the viability and operation of those markets at home and abroad, which is what Tea Party Representative Bachmann bragged about in Iowa.


Tea Party members have obstructed justice by interfering with the work of other government officials, such as the Secretary of the Treasury and members of the Securities and Exchange Commission. Obstruction can include crimes committed by elected officials. In this regard, they were aware that their actions could manipulate markets for the purpose of financial gain of others or themselves. It was obstruction of justice that the House used to impeach President Clinton and brought about President Nixon’s resignation from office.

ea Party members, as elected government officials, have practiced extortion under color of authority. That includes false pretenses, like Cantor’s charge to stick together and “demonstrate that we’re a team that will fight for and stand by our principles.” Their extortion has included promises and representations as well as the deprivation of the right of citizens to the honest services of their elected officials. While extortion is more commonly practiced by and associated with organized crime groups, it is defined as a criminal offense which occurs when a person unlawfully obtains money, property or services from a person(s), entity, or institution, through coercion.

There is no excuse for the Tea Party members of Congress deliberate effort to drive down the credit worthiness of the United States, let alone to do as elected public officials. There is no defense for participating in actions by which people can make money on the resultant market manipulation which is unfolding. That their pattern of behavior has hurt both investors and consumers in the false claim of principal is calumny. Seeking the political defeat of the president by purposely trashing the US economy is criminal.


The administration may feel its hands tied and not unleash the Justice Department to prosecute this alleged criminal activity, but that does not prevent the private sector from bringing these seeming racketeers to justice severally and jointly. The harm that has been perpetrated by the Tea Party cannot be justified. Both criminal and civil litigation under RICO can at least marginalize the Tea Party’s willful and destructive influence in Congress and defeat its members.




They are not above the law.

But the vast majority seem to be "constitutional" militias, fans of low taxes and small government -- values similar to those of many conservatives and the Tea Party movement. ...

... One leading light is Robert Schulz, founder and chairman of We The People Foundation, a non-profit that organized two national gatherings last year. The meetings popularized a check list of alleged constitutional violations cited by elements of the conservative Tea Party movement and militias, according to "Midwifing the Militias", a report by the Southern Poverty Law Centre, a non-profit which tracks hate groups.
Such violations included undeclared foreign wars, gifting and lending money and credit to private corporations, unconstitutional tax levying and unenforced immigration laws. ...

... In the early 1990s the militias were politically isolated. Today, they appear to be an armed point along a much bigger popular continuum that includes the Tea Party and the Oath Keepers, both gaining momentum fast.

Lackomar and other militia members, while certainly sympathetic to the Tea Party's goals, insist the two groups are unconnected -- even informally. "What we've tried to do is to make it so our group does not take political positions, except for constitutional versus unconstitutional, and the necessary focus on the Second Amendment," Lackomar said.

Still, in conversations with Reuters, SMVM members expressed admiration for the Tea Party's rapid growth in the past year and its ability to draw big crowds and mainstream politicians like Sarah Palin.

The online invitation to the SMVM's picnic this year encouraged guests to "show, shoot, shout then sip some tea with us." Lackomar says the reference was designed to appeal "to people who might be put off by the pure militia aspect."

 The picnic culminated with a shooting competition. Among the promised targets: Copies of the U.S. tax form known as the 1040.

The Tea Party movement has sought to distance itself from the militia phenomenon, but the Oath Keeper movement seems closer to it in many ways while also sharing some common ground with the Tea Party.

The Republican Party has a huge problem on their hands. They are quickly being taken over by the most extreme, paranoid, fringe elements in our society and this case is just another glaring example of the path they are on:

BOISE, Idaho — An Idaho Republican Party leader who helped oust the state GOP chairman in 2008 faces charges of aggravated assault with a deadly weapon after an altercation escalated while he photographed a home with a delinquent mortgage.

Challis McAffee, 33, the GOP chairman from the Boise suburb of Garden City and one of 231 voting members of the Idaho Republican Central Committee, was in Ada County jail after being accused of pointing a gun at the homeowner.

McAffee, a backer of libertarian-leaning former GOP presidential candidate Ron Paul and an activist in this year's anti-big-government "Tea Party" protests, helped organize Paul backers who aligned at last June's Idaho State Republican Convention in Sandpoint with other foes of then-state GOP Chairman Kirk Sullivan. Sullivan was voted from office in favor of Norm Semanko.

According to police in the Boise suburb of Meridian, resident Robert Lutes called officers just before 5:30 p.m. Tuesday to report McAffee had pointed a .357 Magnum handgun at him during a verbal confrontation. McAffee acknowledged he pointed the gun at Lutes, according to the police account.

"I'm unarmed, I'm an old man," Lutes, 51, told The Associated Press on Thursday. "I'm trying to find out why he's taking pictures of my house. I said, 'Knock on my door, let me know what you want.' Then, I think he's reaching for his business card and he pulls out a concealed weapon and I think he's going to blow my head off." Read on...

The goings-on of red state Republican officials aren’t usually national news, but this story from Boise is a fitting postscript to a week that started with Second Amendment activists bringing guns to a presidential speech and muttering about “forcefully resisting” the government.

Challis McAffee, a Ron Paul-supporting Republican Party leader from a suburb of Idaho’s capital city, was arrested and charged with aggravated assault with a deadly weapon for pointing a gun at a homeowner. Why was he confronting the homeowner? Well, he was hired “to document the condition of homes where mortgages are past due or in foreclosure.”

Psychopathy (/saɪˈkɒpəθi/^[1][2]) is a mental disorder characterized primarily by a lack of empathy and remorse, shallow emotions, egocentricity, and deceptiveness. Psychopaths are highly prone to antisocial behavior and abusive treatment of others, and are very disproportionately responsible for violent crime. Though lacking empathy and emotional depth, they often manage to pass themselves off as average individuals by feigning emotions and lying about their past.

Characteristics

The prototypical psychopath has deficits or deviance in several areas: interpersonal relationships, emotion, and behavior.^[3] Psychopaths gain satisfaction through antisocial behavior, and do not experience shame, guilt, or remorse for their actions.^[22][23][24] Psychopaths lack a sense of guilt or remorse for any harm they may have caused others, instead rationalizing the behavior, blaming someone else, or denying it outright.^[25][26] Psychopaths also lack empathy towards others in general, resulting in tactlessness, insensitivity, and contemptuousness. Psychopaths can have a superficial charm about them, enabled by a willingness to say anything to anyone without concern for accuracy or truth. Shallow affect also describes the psychopath's tendency for genuine emotion to be short-lived, glib and egocentric, with an overall cold demeanor. They tend to be impulsive and irresponsible, often failing to keep a job or defaulting on debts.^[26] Studies in 2010 at Vanderbilt University revealed that psychopaths seek rewards regardless of consequences or risk, characterised by high impulsivity.^[27]
Hare, whose Hare Psychopathy Checklist is widely used, describes psychopaths as "intraspecies predators".^[28] R.I. Simon also uses the word predator to describe psychopaths.^[29] Elsewhere Hare and others write that psychopaths "use charisma, manipulation, intimidation, sexual intercourse and violence"^{[30][31][32][verification needed]} to control others and to satisfy their own needs. Hare states that: "Lacking in conscience and empathy, they take what they want and do as they please, violating social norms and expectations without guilt or remorse".^[33] He previously stated that: "What is missing, in other words, are the very qualities that allow a human being to live in social harmony".^[34]
According to Hare, many psychopaths are superficially charming, and can excellently mimic normal human emotion;^[10] some psychopaths can blend in, undetected, in a variety of surroundings, including corporate environments.^[35]

Lack of empathy

Psychopaths possess a general lack of empathy; they are simply unable to understand the emotional states of other people, except in a purely detached, intellectual sense.^[36] When an empathetic person sees someone else in pain or distress, he instinctively feels distress as well, but a psychopath never does. Thus, psychopaths can commit acts of stunning cruelty and callousness because they are not deterred by any unpleasant reaction to their victims' suffering. A violent psychopath can mutilate a person with all the emotion of a chef carving up a turkey. A psychopathic con man can swindle his parents out of their life savings and not give a second thought to the ruin he has left them in. Because the experiences of others provoke no emotion in psychopaths, they regard others as little more than objects for their personal gratification.

Shallow emotions

Psychopaths do not feel emotions as deeply as an average person. Though they are not completely unemotional, their emotions are so shallow that some clinicians have described them as mere "proto-emotions: primitive responses to immediate needs."^[37]

Lying and manipulation

Psychopaths are incorrigible and consummate liars. They frequently and readily lie to get what they want, to impress people, or to simply appear normal, and they do so with such skill that even experienced interrogators are sometimes fooled. This talent lies in a confident presentation that never betrays signs of anxiety, hesitation, or shame, even when they're confronted with contradictory evidence or inconvenient questions. ... Average people typically feel anxiety when they lie, hesitating with their words especially when confronted. When a psychopath lies, however, they are completely indifferent to the possibility of being caught in a lie. When they're caught in a lie, they are rarely perplexed or embarrassed. Without hesitating, they will simply rework the tale so that it appears consistent. Some psychopaths also possess great charm and a great ability to manipulate others. They have fewer social inhibitions, are extroverted,^[45] dominant, and confident. They are not afraid of causing offense, being rejected, or being put down. When these things do happen, they tend to dismiss them and are not discouraged from trying again. Thus, psychopaths practice manipulation harder than most people and tend to become very good at it.

Impulsivity, irresponsibility

Psychopaths are impulsive by nature. They do not deeply recognize the risk of being caught, disbelieved or injured as a result of their behavior.^[50] ... Psychopaths often fail to learn from past experiences and do not modify their behavior to avoid trouble. They often pursue the same old bad habits despite having suffered retribution and humiliation numerous times. Punishment and rehabilitation have no positive effect on them, and their condition is considered untreatable.^[54] The rate of recidivism among psychopaths is roughly double that of normal criminals, with the rate for violent recidivism being roughly three times higher than normal.^[55]

Remorselessness

Psychopaths have a total lack of remorse for the abuses they commit. They generally know the difference between right and wrong, but they do not care. Even when they are aware of the consequences of their actions, they frequently rationalize their behavior so as to minimize the seriousness or shrug off responsibility. They often blame their victims for their own crimes; "he shouldn't have provoked me" and "suckers deserve to be swindled" are common sayings.

Egocentricity and grandiosity

Psychopaths have extremely inflated self-esteem. Their egocentricity is comparable to that of narcissists, and indeed it is occasionally hard to distinguish the two conditions from each other.^[58] They think they are the center of the universe and see themselves as superior beings. They often appear arrogant, opinionated, domineering, and cocky. A psychopath always thinks he is the smartest person in the room and has no respect for the differing opinions of others. Psychopaths have an exaggerated sense of entitlement. They expect large rewards for mediocre efforts, apply for important jobs despite lacking qualifications, demand authority and privileges above their rank, and are ungrateful. It is not uncommon for psychopaths to describe their victims as weak, inferior beings who deserve to be taken advantage of.^[59]

Where did the Koch Tea-Party Organized Crime fortune come from? Here you go... the 3 minute history lesson.

In the late 1920s, there was at least one country in the world, where oil was not bought and sold in the usual sense: Communist Russia. The Communists had been trying to take advantage, of their immense oil reserves, since gaining power in 1917, and under Joseph Stalin, the drive to industrial efficiency was pursued, with ruthless speed, but without the benefit of Western technology. Koch Industries founder, Fred Koch, offered to build oil refineries in Communist Russia, that would be more efficient than those in the West. The young engineer's ideas were welcomed, and he was awarded a large contract, to coincide with Stalin's first five-year plan, beginning in 1929. The contract called for construction of 15 refineries, for an initial fee of $5 million, from which Koch and his partner, L. E. Winkler, are said to have netted, a $500,000 profit, which was great wealth, at the peak of the Great Depression years. Koch's work in Communist Russia, necessitated sojourns in that country, offering the Texas farmboy an intimate look at the Soviet system, while providing the cash he would later need in building his U.S. empire. The Winkler-Koch Engineering venture lasted until 1932. Between 1929 and 1932, Stalin purged, starved & worked to death, 7 million Ukranians. Fred Koch returned to the U.S.S.R in 1958. Fred Koch never had any public bad comments to say about Stalinism and Communism until Joseph McCarthy became a threat to people with ties to communist Russian in the early 1960s. Then Fred Koch became a commie-hater, author and speaker while being one of the 12 invited co-founders of the John Birch Society. Like Fred Koch, all of the other co-founders of the John Birch Society were high ranking members of the N.A.M., the National Association of Manufacturers.

Koch-Puppet Herman Cain CHEATED ON HIS MISTRESS

It does not matter if he gets in or gets out. This man is pure evil and his ability to smear people from the sidelines needs to be destroyed -- no aftermarket for speaking tours, no political appointments, no more board of directors cushy jobs paying hundreds of thousands of dollars for a few hours work per month.

He was groping job applicants and waitresses while serving as a political lobbyist to keep smoking legal in restaurants as long as possible. He was on the board of a tobacco company while that tobacco company was under investigation for felony organized crime, and the same company was ultimately convicted of federal RICO felony fraud charges. Cain took a pizza company and brought it from 3rd place to 8th place, closing 200 pizza joints and destroying thousands of jobs. He said the closed pizza locations were bad location choices, but how were they so good three years earlier and then suddenly bad? Cain also exported 4,500 jobs from NEWTON IOWA Maytag when he shipped the factory to Mexico from the board of Whirlpool-Maytag.

The worst thing is CAIN LIED and stole over $30,000,000 taxpayer dollars. The "Stimulus" money was not randomly sent out as checks like a lottery -- companies had to APPLY FOR THE MONEY. Cain was on Agco Corp and Whirlpool, who together took dozens of millions of dollars of jobs stimulus money, but he has publicly said the Stimulus did not create one single job. He LIED to get those millions and he needs to give back the taxpayer Stimulus money that he stole under false pretenses.

While on the Board of Reynolds Holdings, parent to RJ-Reynold Tobacco Company, Cain was Director of Oreos. In the future when he doesn't have a job, and is not rich, throw his words back in his face: "Blame Yourself"!

In 1984, Pillsbury puffed up their stock value, with apparent profits and success, of a rapid expansion, to nine hundred and eleven Godfather's Pizza stores.

By 1986 Pillsbury Corporation needed a hatchetman, to fire people, and to close down unprofitable mistakes which they had made with Godfather's Pizza chain. They called in Herman Cain, prized for his ruthless methods. Cain slaughtered restaurants, created to pad the corporate stock value, and by 1988, under Herman Cain's meat-ax, Godfather's closed approximately 200 restaurants, and eliminated several thousand jobs.

The Godfather's division made a small profit for the first time in three years. Pillsbury had polished the turkey enough to make it attractive to Wall Street again and happilly sold off this loser to an investor group composed of Herman Cain, and some Godfather's senior managers, and to Citibank investors.

Godfather's had slipped from third place to fifth place in the pizza chain ranking. So much for the myth that "Cain turned around Godfather's pizza chain." The chain never again had the volume, never again got to fourth place let alone reclaim third place, never had the earlier profits, or never again had the number of stores which it had before Cain. Currently, the remnants of Godfathers Pizza is less than 600 stores, and Cain did not profit much from his tenure there -- his net worth statement shows nothing special concerning any nest egg or stock holding attributed to Godfathers.

Godfathers is the only success, or claim-to-fame, for Herman Cain as a businessman. Everything else is failures, and is usually omitted from Cain's history by his own people.

In 1994, while still President and CEO of Godfather's, Herman Cain became president of the National Restaurant Association (NRA) and began his active political career, as a speaker and a highly-paid lobbyist for the food industry, while maintaining his title as chairman of Godfather's. His Godfather's CEO duties were handed over to President Ron Gartlan.

Herman Cain cost the National Restaurant Association, $80,000, for two sexual harassment settlements, in 1999, and his employment contract was terminated six months early, and was never renewed. (note: this fact is reported around the internet, but not confirmable.) During this time Herman Cain had other involvements.

He became a Jack Kemp Republican supporter in 1996, while still involved with Godfathers and the National Restaurant Association. Herman Cain created some sexist radio spots, one calling women "hoes" during a period of his life while he was groping women seeking employment, and sexually harassing women already working for the N.R.A.

As he was dying, Cain's choice Jack Kemp's, "Empower America", organization membership list, was transferred to the Koch Brothers "Citizens For A Sound Economy", (C.S.E.), in 2004, providing one linkage between Cain and Koch. C.S.E. morphed into Freedomworks and "Americans for Prosperity" in 2004, and Cain became employed as motivation speaker for AFP in 2005.

Cain's 1988 association with Citibank was fruitful, as Citibank's earlier version had co-created the Federal Reserve system in America, was named deputy chairman, and a director of the Kansas City branch, of the Federal Reserve Bank, one of 12 branches nationwide, between 1989 and 1996. This partially overlapped the time at the NRA.

RJ Reynold's Organized Crime Tobacco Mafia was at that same time named RJR-Nabisco. The Nabisco Holdings Corporation named Cain chairman and chief executive officer to their board of directors. (note: this fact is reported around the internet, but not confirmable.) Subsequent Federal trials and convictions showed that the RJR-Nabisco Corporation was deeply involved in a 50-year on-going felony fraud R.I.C.O. organized crime, and only fellow conspirators wetre promoted to high ranks during this time. "Godfather" Cain was top boss of a since-convicted in court Racketeering serial-murder corporation, which was involved in the killing of 3,000 Americans every single day.

Cain was helpful to the tobacco mafia in organizing anti-reform smoking political actions of the National Restaurant Association across the country. This would bring him into increasing closeness to the Koch Brother's orbit, as the Koch's were activist prime operators of the (since convicted of felony) tobacco mafia.

Cain has been on the board of directors of several companies, including Aquila Inc., Nabisco, Whirlpool, Reader's Digest, Hallmark Cards and AGCO Inc. Likely some of these were return favors for services provided to the corporate tobacco mafia.

On the Board of Whirlpool home appliances, Cain oversaw the takeover of rival Maytag, then the year 2006, slaughter of 4,500 jobs in Newton, Iowa, as the American, washer and dryer factory, was moved south to Mexico.

On the Board of Directors of Aquila Energy, Cain helped steer the company in the same direction as Enron. Employees were suckered into putting their pensions and life savings into Aquila stocks, which lost it's value when Enron collapsed the market for energy scammers. Cain's board of directors was sued by stockholders and employees for ten million five hundred thousand dollars. A private settlement was reached without details being made public, but Aquila was destroyed ultimately and no longer exists. Most employees lost their jobs as parts of the company were sold off to other energy companies.

Once again Cain was in the boss's circle of a losing corporate entity with massive job losses. In reality, Cain has been the kiss of death for some of those corporations associated with him.


According to his personal financial disclosure, Cain supplements his income by being a board member for several large corporations. As a board member, he collected $202,500 from Agco Corporation, a farm products company, and $259,008 from Whirlpool Corporation (including options and a board salary). A review of stimulus spending records reveal that Cain’s companies have eagerly accepted stimulus money:

    – Agco Corporation received up to $5 million of stimulus grants to develop “supply systems to handle and deliver high tonnage biomass feedstocks for cellulosic biofuels production.” Rich Koch is Chairman of Agco.

    – Whirlpool Corporation received a $19,330,000 stimulus grant from the Department of Energy to develop SmartGrid solutions.

    – Whirlpool launched a special offer to encourage customers to take advantage of the stimulus program’s energy efficient appliance program. The company advertised that certain Whirlpool, Maytag and KitchenAid appliances are available for rebate through the $300 million rebate program authorized by the stimulus.

    – Whirlpool also received two stimulus grants of $2,042,700 to develop next generation energy efficient refrigerators.

One of Cain's corporations did not appear to receive any tainted stimulus money. According to his disclosure, Cain received $120,000 for his role on the board of Hallmark Cards Inc, the holiday greeting card company.

Tea party backer David Koch is now number one after his income soared from $16 billion to $21.5 billion in 2009.
